Terms & Conditions

By using Virgin Media eBilling, you agree to accept and abide by the terms and conditions set out below. Just so you know, these Terms and Conditions apply in full and, if you don't wish to be bound by them, please don't subscribe to eBilling. Make sure you read them carefully and in full before signing up.

1. Virgin Media eBilling is operated by Virgin Media Limited, whose registered office address is at 160 Great Portland Street, London, W1W 5QA. (company number 2591237).

2 By using the eBilling service, you accept that you will no longer receive a paper bill every month.

3. You must have a valid email account to use eBilling. You must provide us with the correct and currently valid address of the email account to which you would like notification of your bill availability to be sent. The accuracy of that email address is entirely your responsibility and in particular, but without limitation, should that email account ever become invalid or should you wish notification of your bill availability to be sent to a different email account, it's your responsibility to notify us. You shall remain fully liable for any bills of which notification has been sent to your previous email address.

4. Virgin Media reserves the right to refuse use of the eBilling service to anyone for any reason whatsoever in its absolute discretion. Further, we reserve the right to modify or discontinue (permanently or temporarily) the eBilling service to you or all recipients at our discretion.

5. Virgin Media accepts liability in full for any personal injury or death caused by its negligence and for any fraudulent misrepresentation. However, to the extent permitted by applicable law, we hereby exclude any and all other liabilities and/or responsibilities and disclaim any and all warranties, whether express or implied, statutory or otherwise relating to the eBilling service, the information contained on it and/or its use.

6. Any instructions that you give to Virgin Media via eBilling are subject to acceptance by us and you should not believe or assume they have been accepted unless and until confirmed.

7. All bills of which notification is sent to you by email are payable to Virgin Media Payments Ltd, whose registered office address is 160 Great Portland Street, London, W1W 5QA, (company number 6024812) and are due and payable on the "date due" of each bill. You shall remain fully responsible and liable to pay any bills of which notification has been sent to the email address you have specified, regardless of whether or not you access that email account and read the relevant email, are disconnected from your email account (for any reason and whether by Virgin Media or otherwise) or for any other reason (other than Virgin Media's negligence) fail to read the relevant notification.

8. Should you not pay any bill on or before the date on which it is due and payable, Virgin Media reserves the right to claim interest from the date on which it is due and payable to the date it is actually paid in full.

9. If you do not pay your bills on time, Virgin Media also reserves the right to charge you a late payment fee of £10 (as at January 2007). Please see clause F3 of the Terms and Conditions of our services.

10. Bills may be paid to Virgin Media Payments Ltd by any of the following methods:

  • most major credit cards or debit cards on-line;
  • Direct DebitPlease note that if you do not pay by Direct Debit, Virgin Media Payments Ltd will charge you a separate payment handling fee of £5 per month.

11. If you wish to cancel use of eBilling, you should notify us immediately by calling 0845 454 1111. We will cancel your eBilling account within 10 days of such notification, and after that date no further notification of any bills will be sent to you by email. However, you shall remain fully responsible for payment in full, to Virgin Media Payments Ltd, of any bills of which notification has been sent to you on or before the date on which your eBilling account has been cancelled.

12. Your PIN number should be kept secret and Virgin Media accepts no responsibility or liability in the event that your PIN number is used by anyone else to access your account (save for personal injury or death caused by our negligence). Virgin Media accepts no responsibility or liability in the event that any correspondence informing you of your PIN number is opened or read by anyone else and, in the event that you do not receive your PIN number within 7 days of opening your eBilling account or if you have reason to believe that anyone else knows your PIN number, you should contact us immediately on 0345 454 1111 and request that a new PIN be sent.

13. Virgin Media cannot guarantee uninterrupted and/or reliable access to the eBilling service and makes no guarantees whatsoever as to its operation, availability, functionality, that it will be free of error or disruption or otherwise. We will provide notice to you regarding permanent discontinuance of service where the circumstances reasonably allow. We may prevent you from using the service immediately without notice if you breach any of these terms and conditions.

14. While Virgin Media does not charge for the eBilling service itself, you may be required to pay access fees and/or call charges necessary to access your emails to whoever provides such access to you. Your liability to pay any such charges (whether to Virgin Media or otherwise) shall have no effect on, nor shall it affect, any of your obligations in relation to the eBilling service.

15. Virgin Media Ltd and Virgin Media Payments Ltd will take reasonable care (to the extent that it is within our power to do so) to keep any credit card or other details that you may supply us with secure but we cannot promise that security breaches will never occur. Our entire responsibility to you regarding any security breach will be to endeavour to prevent its continuance or repetition once the problem is drawn to our attention. All other responsibilities and liabilities (other than for death or personal injury) are hereby excluded.

16. You agree to use the eBilling service responsibly. You will not:

  • use eBilling for any fraudulent or other illegal purpose or to interrupt or damage our services, or to make them less efficient;
  • use eBilling for the transmission of any defamatory, racist, blasphemous or obscene message;
  • or do anything that affects the operability or security of eBilling or causes unreasonable inconvenience, or offence or disruption to, Virgin Media or any of its staff.

17. All materials (including, without limitation, all designs, text, graphics and their selection and arrangement) relating to the eBilling service are the copyright of Virgin Media. No such material may be copied or reproduced in any form whatsoever, whether physical, electronic or otherwise, without our express, prior, written consent.

18. The eBilling service is intended for use by residents of the United Kingdom only and is not aimed at or intended for use by residents of any other country.

19. Virgin Media Ltd and Virgin Media Payments Ltd expressly reserve the right to alter these terms and conditions from time to time by posting new terms and conditions on the eBilling service. We will make the latest version of our terms available for you to read at all times. Your use of Virgin Media eBilling and your access to eBilling will be deemed an acceptance of the terms existing at the time.

20. If any provision of these terms and conditions shall be unlawful, void or unenforceable for any reason then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

21. These terms and conditions shall be governed by and construed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of the Courts of England.

22. None of the provisions in these terms and conditions affect your statutory right as a consumer.
